Prints - Terms and conditions of sale

The following terms and conditions of sale (herein also referred to as ‘terms’ or ‘terms and conditions') apply to the purchase of all fine art paper prints and materials via this website (herein referred to as 'print’, prints or print(s)). They form part of a contract that will be created between me (‘Colin Henderson Photography', ‘Photographer’, ‘I', ‘me') and you (‘Customer', ‘you'), should you choose to purchase a print, and are the benchmark we’ll refer to in the unlikely event of any dispute.

By purchasing a print, you acknowledge and agree to the terms and conditions detailed below;

1. What you are purchasing

I operate a minimum print size, which is 18 inches wide for non-panoramic prints and 24 inches wide for panoramas. Custom sizes are also available. Please do enquire and I’ll attempt to meet your needs.

All orders are for the purchase of tailor-made prints produced by a Giclée fine art production process, using premium-quality, archival-standard inks, mounts and paper which are designed to produce museum-quality prints that resist fading. (An average Giclée life expectancy, in daylight conditions, has been indicated at 80 years).

  • Fine art paper prints - Purchase a paper print and it will arrive professionally packaged with a visible white border, 1/2 inch all round, that enables it to be more easily handled and/or attached to a window matt. The sizes I offer are for the image itself and, with the inclusion of the white border, a 12x18in print, for example, is 13x19in in dimension.

  • Fine art paper prints (Framed) - Depending on my availability and your budget, I’m happy to facilitate a framing service where I’ll personally choose the materials to most appropriately match your print. Your print will be prepared professionally as above before being presented for you within a window matt and a solid wood frame behind anti-reflective art glass that's specially designed to enhance your viewing. All frames I select are FSC-certified, created from solid woods from sustainable sources and, along with the rest of the print materials I choose, 100% acid-free. Please contact me for pricing.

Important - Devices such as computer monitors, tablets, phones and printers can all produce slightly different colours and tones. The tonal contrast and colours of your print may therefore vary according to what you see on your computer screen or printer. I’m not able to guarantee an exact colour or tonal match with your computer screen or printer.

2. Uniqueness of print

All prints are sold as ‘open editions’, with no signature or certification provided. An unlimited amount of each print is available.

3. Customer responsibilities

By purchasing a print, you’re confirming that you have read the information I have provided and selected the appropriate size. You are responsible for ensuring the accuracy of your order details and I will not be liable for any failure by you to provide me with the correct information in your order. Please contact me if you wish to discuss purchasing a bespoke print size, not shared online. These may be available but cannot be guaranteed.

4. Order confirmation

Orders are only deemed to have been accepted by me once you have received my order confirmation email.

I reserve the right to;

  • Reject or pause any order submitted by you for any reason.

  • Cancel any order before delivery of the print in the event that any payment of the full order value fails.

I shall not be liable to you, or any third party, for any loss, incidental or consequential damages of any kind, including, without limitation, punitive or economic damages or lost profits that may be caused to you as a result of any rejection, pause or cancellation of an order by me.

5. Delivery

Please allow 10 days for the production of your print (on occasion sometimes longer). Prints will be shipped to you directly from my print supplier, using a trackable courier service. I’ll provide you with an indication of your delivery date in my response.

Delivery will be classed as complete when the print(s) are confirmed as being delivered to the shipping address you provide or the print(s) are confirmed as being collected by you from the courier’s depot if you weren’t available at the time of their delivery.

On receipt, please tell me immediately if there are any defects or damage to the print(s). Failure to inform me of any defects or damage to the print(s) within 24 hours of any delivery receipt will confirm your acceptance of the print(s) in good condition.

Payment of any additional charges relating to the purchase of your print(s), e.g. customs charges or local taxes, are the responsibility of you as the Customer.

6. Returns

All print orders are for tailor-made, printed-to-order photographic prints. As such, any right to reject, return, exchange or cancel your order under the Consumer Contracts Regulations does not apply unless the prints(s) are damaged or defective. Please choose carefully as replacements will not be provided unless the following criteria is met;

  1. I will replace, free of charge, any print(s) which are defective as a result of a manufacturing error (e.g. a mistake I’ve made when I’ve prepared the print(s)).

  2. I will replace, free of charge, any print(s) which have been damaged prior to delivery, where you have informed me within 24 hours of delivery receipt (see section 5 - ‘Delivery’).

Prints classed as defective are to be returned to me in advance for review, using a prescribed delivery format. (I’ll refund your delivery charges on my agreement of the defect or damage).

Any damage caused after a completed delivery is the responsibility of the Customer and any replacement(s) will only be provided subject to an additional payment being made by you that is equal to the current price I charge for prints, plus postage.

Please request a small test print if you’re not sure. Test prints are marked as such and are payable at cost price plus postage.

7. Print guarantee

All prints are meticulously produced on my behalf by a trusted supplier following a Giclée fine art production process, using top-quality archival inks, mounts and papers that resist fading.

8. Pricing of prints and delivery

The price of print(s) does not include delivery charges and current courier costs at the time of order will apply. Pricing for delivery (and the price of my prints) may change from time to time. Changes will not affect any orders for which you have already received an order confirmation.

9. Copyright and ownership of materials

You own the print(s) once I have received payment of the indicated price in full, including delivery charges. All title and intellectual property rights (including copyright) for the photographs illustrated in the print(s), in all media worldwide, shall vest in the Photographer and be retained by me as the Photographer.

10. Rights of use

By purchasing the selected print(s), you agree and acknowledge that you are not acquiring any rights or title related to the photograph therein, only the right to possess, hold and use the Print(s) for non-commercial purposes. Furthermore, you agree that you will: (i) not scan, copy, duplicate or otherwise reproduce the Print(s), (ii) not use the Print(s) for any editorial or commercial (e.g. advertising) purposes and (iii) indemnify the Photographer against any claims, losses or damages incurred as a result of or in connection with any breach of these restrictions.

11. Payment

Payment for print(s) and all applicable delivery charges must be made in advance. Payment for print(s) can be made online by bank transfer or by using my chosen secure credit card gateway, Paypal. Once payment is received, and on receipt of your order confirmation, the contract between us shall be deemed to be in force and all applicable clauses and terms detailed herein will apply.

12. Security of your personal information

Please view my Privacy policy for the steps I take as a business to secure your personal information.

13. Applicable law

This agreement shall be governed by the laws of Scotland and are subject to the exclusive jurisdiction of the Scottish courts, to whom all parties submit.

14. Severability

Notwithstanding that the whole or any part of any provisions of the Agreement may prove to be illegal or unenforceable, the other provisions and the remainder of the provision in question will remain in full force and effect.

15. Variation

These terms and conditions prevail over any varying terms and conditions supplied by the Customer, or implied by law, trade custom or course of dealing. They shall not be varied except by agreement in writing from the Photographer. The terms and conditions of sale applicable to your contract will be determined as those which were published and active on the date your order was placed.
